Excerpts of Public Law 101-36, July 16, 1990:
An act to establish a clear and comprehensive prohibition of discrimination on the basis
of disability.
As used in this title:
(1) PUBLIC ENTITY
The term "public entity" means:
(A) Any State or local government;
(B) Any department, agency, special purpose district, or other instrumentality of a State or States or local government.
(2) QUALIFIED INDIVIDUAL WITH A DISABILITY
The term "qualified individual with a disability" means an individual with a disability who, with or without reasonable modifications to rule, policies or practices, the removal of architectural, communication, or transportation barriers, or the provision of auxiliary aids and services, meets the essential eligibility requirements for the receipt of services or the participation in programs or activities provided by a public entity.
Subject to the provisions of this title, no qualified individual with a disability shall, by reason of such disability, be excluded from participation in, or be denied the benefits of, the services, programs, or activities of a public entity, or be subjected to discrimination of any such entity.
PUBLIC ACCOMMODATION.
The following private entities are considered public accommodations for purposes of this title, if the operations of such entities affect commerce:
(A) and (B) do not apply;
(C) a park, zoo amusement park, other places of recreation;
(D) a nursery, elementary, secondary, undergraduate or postgraduate private school, or other place of education;
(E) a day care center, senior citizen center, homeless shelter, food bank, adoption agency, or other social service center establishment; and
(F) a gymnasium, health spa, bowling alley, golf course, or other place of exercise or recreation.
No individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodation by any person who owns, leases (or leases to), or operates a place of public accommodation.
